1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to Australian residents only. Entrants under 18 years of age must seek permission from a parent/guardian to enter this promotion. Employees (and their immediate families) of the Promoter, participating retailers, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process, including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS/190 call costs. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights

4. If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the mobile phone/internet account is held.

5. Promotion commences at 09:00am (AEST) on 08/09/08 and eligible purchases must be made between 08/09/08 and close of business on 16/11/08 (the "Competition Period"). The final closing date for entries is 11:59pm (AEST) on 16/11/08.

6. To be eligible to enter, consumers must purchase any Helga's Bread product from a participating store nationally during the Competition Period.

7. To enter, consumers must then either:
  1. Visit www.helgasfilmfestival.com.au, follow the prompts to the competition entry page and fully complete the online entry form with all requested details, including the last five (5) digits of the product barcode, full name, postal address, a valid email address and contact phone number, and submit the fully completed entry form by 11:59pm AEST on 16/11/08; or
  2. Call 1902 555 005 (by 11:59pm AEST on 16/11/08) and leave the requested details when prompted including full name, daytime and/or mobile number, address and the last five (5) digits of the product barcode. Maximum cost of 190 call is 55c. Calls from mobile and pay phones may attract a higher rate. Service provider: Dialect; or
  3. Send an SMS (by 11:59pm AEST on 16/11/08) containing the last 5 digits of the product barcode, their full name and postcode to 1997 6699 in that order. (eg. 12345 First name Last name 2000).
8. The draw will take place at Dialect Interactive, Level 9, 190 George Street, Sydney NSW 2000 at 3pm AEDST on 1/12/08. The Major Prize winners will be notified by telephone and mail and their name will be published in The Australian on 29/12/08.

9. Prizes:
  1. Major Prize - The first two (2) valid entries drawn will each win a trip for two (2) people to Cannes, France, valued at up to AUD$30,900 depending on point of departure.

    The prize includes:

    • Return economy class airfares from the winner's nearest Australian state or territory capital city to Nice, France;
    • Helicopter transfer from Nice airport to Cannes;
    • Private car transfers from the helicopter pad to the Majestic Barriere Hotel;
    • Five (5) nights twin share accommodation in a standard room in Cannes at the Majestic Barriere Hotel;
    • 2 x tickets to an exclusive party to the VIP ROOM Cannes Palm Beach during the 2009 Cannes Film Festival;
    • 1st class rail transfers from Cannes to Nice for two (2) people;
    • Private car transfers from Nice train station to Nice Garden Hotel;
    • Eight (8) nights twin share accommodation in a standard room in Nice at Nice Garden Hotel;
    • Private car transfer from Nice Garden Hotel to Nice airport; and
    • AUD$1,000 spending money.

    The prize does not include expenses associated with any of the following:

    • Additional transport other than airfares and transfers specified above;
    • Items of a personal nature including room service, parking fees, telephone, in-room video, mini-bar and other incidentals;
    • Meals;
    • Travel insurance, medical insurance or expenses and any other insurance;
    • Visas, passports, or vaccinations;
    • Optional tours;
    • Laundry;
    • Telephone calls;
    • Additional nights;
    • Room upgrades;
    • Airport taxes; or
    • other ancillary costs associated with redeeming the prize other than those specified. Any extension to the duration of the prize is at the winner's sole expense and subject to availability at the time of booking.

    Travel prize conditions:

    • Prize must be taken to coincide with the Cannes VIP Room event with flights departing on 13/05/09 and is subject to booking and flight availability;
    • Prize is subject to availability at time of booking, and any or all components of the Prize may no longer be available at time of booking;
    • Travel suppliers/airlines to be chosen at the discretion of Granted;
    • All passengers must travel together on the same flights and stay at the same properties in each destination and share a room;
    • Once booking is confirmed, changes will incur a fee of $150 per person, including GST plus supplier charges. Change fees are the sole responsibility of the winner;
    • Itinerary to be determined by the Promoter in its absolute discretion;
    • Travel insurance is recommended but associated cost of insurance remains sole responsibility of the winner;
    • Winner and their companion may be required to sign a liability waiver form prior to accepting the prize;
    • It is a condition of accepting the prize that the winner (and his/her traveling companion) must comply with all the terms and conditions of use of the prize and prize supplier's requirements;
    • If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash;
    • It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at the hotel;
    • If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian; and
    • The winner (and his/her companion) must depart from and return to the same departure point and travel together.

  2. Instant Prizes - 200 x DVD Boxset valued at $179.75. The DVD Boxset consists of 5 x European DVDs. Titles of the DVDs is determined by the Promoter in its absolute descretion. Instant Prizes will be randomly awarded throughout the promotional period. Instant Prize Winners from SA will be published in The Advertiser on 29/12/08.
10. Premium SMS cost is 55c including GST. Entrants must have premium service access. SMS winners will be contacted by phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. SMS service provider is Dialect Interactive.

11. Maximum cost of 190 call is 55c. Calls from payphones and mobile phones may attract a higher rate. 190 service provider: Dialect.

12. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

13. All entries are deemed to be received at the time of receipt into the promotional database and NOT at the time of transmission by the entrant.

14. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of 5 entries per person per day is permitted.

15. Entrants must retain their original purchase receipt(s) or a photocopy of their receipt(s) for all entries as proof of purchase, dated during the Competition Period but prior to entry to qualify to receive a prize. Failure to produce proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, deem all entries submitted by that entrant invalid and therefore ineligible to receive a prize.

16. Incomplete, indecipherable or illegible entries will be deemed invalid.

17. Total prize pool value is AUD$97,750 including GST.

18. The value of all prizes is accurate as at the commencement of Promotion. The Promoter accepts no responsibility for any variation in the value of the Prizes after this date.

19. The Promoter's decision is final and no correspondence will be entered into.

20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

21. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher/ticket/pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher/ticket/pass. The Promoter will not be liable for any voucher/ticket/pass that has been lost, stolen, forged, damaged or tampered with in any way.

22. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.

23. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

24. A draw for any unclaimed prizes may take place on 02/03/09 at 10:00am (AEDST) at the same place as the original draws, subject to any directions from a regulatory authority. Winners will be notified by telephone and mail and the Major Prize winners' name(s) will be published in The Australian and Instant Prize winners' names(s) from SA will be published in The Advertiser on 10/03/09. The Promoter's decision is final and no correspondence will be entered into.

25. If the Major Prize winner is under the age of 18 years on or before the day of the Major Prize draw, the prize will be awarded to the winner's nominated parent or guardian.

26. The Promoter and any of their employees, contractors and agents or employees of their contractors and agents, reserve the right to refuse to allow a winner or any/all companions to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a winner is not, in the Promoter's or contractors/agent's opinion, in a condition necessary to be able to take or participate in the prize. The winner and their companions may be required to sign a legal release and/or other documentation in a form determined by the Promoter in its absolute discretion.

27. By entering the promotion via SMS, an entrant consents to the Promoter using their personal details for the purposes of sending one (1) mobile terminated (MT) reply message which includes a confirmation of your entry in the promotion and/or details of a special offer made by one (1) of the Promoter's partners.

28. By entering the promotion via the internet an entrant is aware that internet connection fees may occur.

29. It is a condition of accepting a prize that the winner agrees to be interviewed, photographed and filmed at any time during the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured by the Promoter (or any other form of media it deems suitable) without further remuneration or reference to the participant. The decision to include any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

30. Participants must ensure that all care is taken when sending messages to the promotional number. It is the complete responsibility of the participant to ensure that they SMS the correct number, in the event that an error occurs the Promoter accepts no responsibility for any costs incurred, responses received or any other consequences, which remain the responsibility of the participant.

31. The Promoter accepts no responsibility for any Web/SMS messages not received by the Promoter or delays in the delivery of the Web/SMS message due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter's software system, not when it was sent from the computer device/handset.

32. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the mobile phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

33. The winner accepts their prize at their own risk. To the full extent permitted by law the Promoter, and any of their employees, contractors and agents or employees of their contractors and agents, and companies providing prizes for the Promotion, will not be held liable for any liability/loss/damage/expense/death/personal injury suffered or incurred or any damage/loss (including, but not limited to, direct/indirect/consequential loss) arising out of, or in connection with this Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) use of or participation in a prize; or (g) promotion of this competition.

34. As a condition of accepting a Helga's Film Festival Major Prize, the winner (and his/her companion, if applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

35. The Promoter, and any of their employees, contractors and agents or employees of their contractors and agents, accepts no responsibility for late, lost or misdirected entries.

36. The Promoter and its related bodies corporate make no warranties and accept no liability in relation to any prize, its condition or fitness for any purpose. All warranty claims should be directed to the manufacturer of the prize.

37. The Promoter and any of their employees, contractors and agents or employees of their contractors and agents, is not responsible for any problems or technical malfunction of any servers or providers, computer equipment, software, technical problems or traffic congestion, or any combination thereof, or any other technical failures including any damage to entrants or any other person's computer related to, or resulting from, participating in this promotion.

38. If for any reason the Promoter, or any of their employees, contractors and agents or employees of their contractors and agents, determines in good faith and its sole discretion that this promotion is not capable of running safely as planned, including but not limited to events such as infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, including but not limited to vandalism, power failures, tempests, natural disasters, Acts of God, civil unrest and strikes, which might corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right and may in its absolute discretion cancel or suspend the promotion and recommence it on similar Terms and Conditions, subject to State and/or Territory regulations.

39. All entries become the property of the Promoter. The information from the entries is being collected by the Promoter to enable it to contact the potential winner and/or may be entered into a database. By entering the Promotion all entrants consent to the Promoter using the entrant's personal details for an indefinite period (unless consent is later retracted) for future promotional, marketing, publicity, research or profiling purposes including sending electronic messages or telephoning the entrant unless otherwise advised by the entrant upon entry. Entrants entering using the 1902 telephone number or SMS should contact the Promoter using the details in clause 42 if they wish to advise consent is not given for contact in relation to marketing purposes. All personal details of the entrants will be stored at the office of the Promoter and a request to access, update, correct or delete any information can be made by contacting the Promoter at their address set out below. You consent to the Promoter's use and disclosure of information about you as contemplated by this condition.

40. Should a participant's contact details change during the Competition Period, it is the participant's responsibility to notify the Promoter.
